If we set a sick leave policy in place as of this week – can we count back to the beginning of the year for those who have already
taken sick days? Or can we only start counting their sick days from the day we set the policy?
If the policy goes into effect today, do not go back retroactive. I am not an attorney, but I believe you may have some legal implications to deal with if you do this. It is very important that you are consistent across the board with employees otherwise you could be looking at employee discrimination issues.
When creating a company policy, make sure to place a dated footnote in the bottom corner of the page. When you update the policy, change the date and mark it as “revised”.
