An accusation the San Francisco Examiner engaged in predatory pricing is expected to be retried after a California appeals court overturned a jury verdict in favor of the San Francisco Independent.
The Independent, a free, thrice-weekly paper with a 211,000-household distribution, claimed
the Examiner, daily circulation 113,000, underbid on a 1994-95 city contract to publish official notices. A San Francisco Superior Court jury in 1996 awarded the Independent $1.15 million, plus $2.23 million for attorneys' fees. An appeals court reversed the decision Aug. 20, ruling that crucial evidence favoring the Examiner was excluded from the first trial.
