U.S. Panel Hears Arguments On Streaming Royalty Rate

Record companies, webcasters, broadcast networks, and artists' unions convened before the U.S. Copyright Arbitration Royalty Panel (CARP) yesterday in an effort to establish a fair statutory license rate for Internet firms that stream copyrighted recordings. Webcasters offered a rate of .00015 cents

per listener hour. Ken Steinthal, who represents 19 webcasters including MTVi, says the figure reflects the median rate traditional radio stations pay performing rights societies for the use of musical compositions, discounted to take into consideration the "extra promotional value of Internet radio airplay to sound-recording owners." In a statement, the RIAA says it wants rates "consistent with the rates that we have negotiated in the free market"?a figure of about .004 cents per track. The American Federation of Television and Radio Artists wants a rate that reflects "the time, effort, and fair value of the artists' creative efforts."

CARP expects to render a decision later this year.
