Major Labels Sue MP3Board

Thirteen labels have filed a copyright infringement lawsuit against MP3 search engine, MP3Board.com, claiming that the Web site actively assists consumers in finding and distributing illegal MP3 files. The suit, filed Friday in U.S. District Court for the Southern District of New York, alleges that the site is "cultivating a huge network of computer users who seek to distribute their own unauthorized MP3 sound recordings."

"They're not sitting there passively linking to other sites," says Katherine B. Forrest, attorney for Warner Bros. Records, Atlantic Recording Corp., and Elektra Entertainment Group. Other plaintiffs include Capitol Records, BMG, Universal Music Group, Sony Music Entertainment, and Hollywood Records.

The labels seek an injunction and damages that could run as high as $150,000 per infringement.

On June 2, MP3Board Inc., which has an agreement in principle to be purchased by National Record Mart, filed a suit in Northern California against the RIAA after receiving a letter from the RIAAdemanding that the site cease its allegedly infringing conduct; the suit seeks a ruling that MP3Board's service does not infringe on copyrights. MP3Board attorney Ira P. Rothken says the company will try to consolidate the cases in California and will file a motion to transfer.
