FCC: No Fine Yet Against Infinity
The FCC is denying press reports that the commission is poised to level a $1.5 million indecency fine against Viacom's Infinity Corp. for the same programming on the Howard Stern Show that brought down a $495,000 fine
on Clear Channel Corp. on April 6.
"It's wholly inaccurate," says enforcement bureau spokeswoman Janice Weiss. "It is not by any means a fait accompli."
However, Weiss reiterated that the commission wrote in CCC's notice of liability that it will review the programming carried on Infinity's 19 stations nationwide.
The maximum FCC fine for indecent programming is currently $27,500. If the commission rules as it did in the CCC case that the Stern show committed 18 violations per station, the fine would total $1.5 million.
