Volume 26:3 carried a report on a Federal Judicial Center study of U.S. Courts of Appeals' citations to unpublished opinions, cited as "Tim Reagan (and others), Citation to Unpublished Opinions in the Federal Courts of Appeals" and shown as containing 170 pp. That "Of Note" item was based on a preliminary

version of the FJC study. That study has now been formally published; it should be cited and referenced as Robert Timothy Reagan (with others), Citing Unpublished Opinions in Federal Appeals (Washington, DC: Federal Judicial Center, 2005.) Essentially the same report as that earlier reported, this final version has 307 pages, including exhibits and appendices. It contains a little more history of citation rules than the initial version; an exhibit with somewhat more analysis of what gets cited; and descriptions of all cases examined for the survey of cases. The attorney survey includes a few responses received after the release of the June version of the report. SLW
