Michigan Panel Allows Evidence Of Separate Driver Screening.

Evidence that a truck driver was involved in a previous accident while intoxicated and a positive drug test in another case was properly brought before a jury in assessing damages, the Michigan Court of Appeals found.

The court found a jury issued a reasonable decision in reducing damages to a plaintiff upon finding him partially negligent in failing to avoid a collision of his vehicle with a semi-truck, the panel held.
