Promusicae, the Spanish record industry's trade association, is considering an appeal against a judge's decision in July 2006 to acquit a defendant of transfering copyrighted music files online. The accused also exchanged CDs of downloaded music with other web users through the post without payment. The judge ruled that this use of the peer-to-peer (P2P) network was not illegal, as branding it unlawful would be 'criminalising socially admitted and widely practised behaviour where the aim is not to gain wealth illegally, but to obtain private copies'.
