CORPS PREVAILS IN PERMITS CASE: For the second time in a month the Corps of Engineers has prevailed in a major court case involving its ability to issue permits under section 404 of the Clean Water Act (CWA). The latest decision, issued by the federal Court of Appeals, (Fourth Circuit), upheld the Corps and the Environmental Protection Agency regarding the joint jurisdiction they share under the CWA.
