To Sue or Not to Sue?

* From  Date: Friday, November 26 2004

One of my suppliers breached a contract with me and I am ready to sue. Any suggestions?

Lawsuits make me very nervous. Here’s why: A lawsuit is a legalized form of war. You must be willing to do what it takes and spend what is necessary to succeed. Whenever someone's ready to sue, I urge them to consider this: You'll be spending the next year to three years fighting over this incident, and probably paying lawyers anywhere from $5,000 to $100,000 to prosecute the suit. Not only that, but there's no guarantee you'll win.

This is not to say that all lawsuits are bad. In your case, it sounds as if you were legitimately injured. But know what you're getting into before you get started, and make a rational decision not based on ego or anger. Good luck.
