Corps upheld on penalty ruling but board cuts delay period.(Contractors Corner)

The Armed Services Board of Contract Appeals has ruled that a contractor's late completion was not excused by the failure of government inspectors to alert the contractor to deficiencies in the work. But not all the deficiencies related to the use and occupancy of the building.

The Corps awarded a contract to Amigo Building Corp. to renovate a barracks building at Fort Polk, La. The contract, which contained standard liquidated damages and inspection of construction clauses, called for substantial completion in 250 calendar days with liquidated damages of $575 per day
