Verdicts & Settlements September 26, 2005: $27M for death of girl killed by truck

A San Francisco jury awarded $27 million to relatives of a 4- year-old girl who was killed in 2003 when she was hit by a truck.

The Sept. 1 verdict is the largest personal injury award ever made by a jury against the city or county of San Francisco, according to City Attorney Dennis Herrera.

According to the newspaper, Elizabeth Dominguez was walking on the sidewalk after crossing an intersection with her mother on Feb. 11, 2003, when a truck driven by Sebastian Garcia struck and pinned the girl against a restaurant. The girl died at the scene.

After almost five days of deliberations, the jury agreed with the Dominguez family that the city should have improved safety at the busy intersection before the accident occurred.

The family was represented by Brian J. Panish and Kevin R. Boyle, both of Los Angeles.

Garcia, who was initially investigated for running a red light, was charged with misdemeanor vehicular manslaughter. He is scheduled to stand trial in January.
