U.S. Environmental Protection Agency Administrator Michael Leavitt wants the U.S. Supreme Court to review an appeals court decision that has hampered the agency's efforts to force the Tennessee Valley Authority to reduce its power plant emissions.

The U.S. Department of Justice filed a request Feb. 13 asking the high court to consider overturning a June 2003 decision by the 11th Circuit Court of Appeals in Atlanta. That decision has prevented the EPA from enforcing an administrative order requiring the TVA to install additional pollut
