WASHINGTON -- The U.S. Department of Labor recently published the final version of the notice employers are required to use to inform employees of their rights, benefits and obligations under the Uniformed Services Employment and Reemployment Act (USERRA). As of January 18, all employers must meet

the USERRA notification requirement by either posting the new notice or using other methods, such as handing it out or mailing it to current employees and all employees who join the company in the future.

The revised USERRA notice, which has a publication date of December 2005, broadens the class of individuals whose job rights are protected to include anyone returning to work after service in the National Disaster Medical System (NDMS). The previous USERRA notice, first published in February 2005, only provided job protection for those called to active duty in the uniformed services.

The NDMS is an agency within the U.S. Department of Homeland Security, Federal Emergency Management Agency. It is responsible for supporting federal agencies that respond to major natural disasters, transportation accidents or acts of terrorism.

In the new notice information has been changed about requesting referrals for cases that the U. S. Department of Labor, Veterans Employment and Training Service (VETS) has been unable to resolve. New information has also been added regarding claims against federal executive agencies.
