What: Hersh & Hersh, a 30-year-old San Francisco civil litigation firm, filed a petition with the California State Supreme Court. The petition aims to prohibit Secretary

of State Kevin Shelley from imposing erroneous requirements on candidates seeking to succeed the incumbent Governor in the event he is recalled and an election is held. The State Supreme Court has found merit to the petition and has requested an opposition briefing from Secretary of State, Kevin Shelley. Mr. Shelley's office has until Monday August 4, 2003, by 12:00 p.m. PT to respond.

The petition was filed at the California State Supreme Court in San Francisco on Wednesday, July 30 at 3:00 p.m. PT.

Why: Attorneys claim that candidates' requirements, including a $3,500 submission fee and 65 signatures from registered voters, are unlawful. The petition, which cites Elections Code section 8400, states that those seeking statewide office must submit nomination papers signed by voters of the state equal to and not less in number than one percent of the entire number of registered voters of the state at the time of the close of registration and prior to a general election. The Secretary of State is not enforcing this provision.
