Business Definition for: contract

contract

in general, agreement by which rights or acts are exchanged for lawful consideration. To be valid, it must be entered into by competent parties, must cover a legal and moral transaction, must possess mutuality, and must represent a meeting of minds. Countless transactions in finance and investments are covered by contracts.

contract

  1. General. An agreement backed by lawful consideration to carry out actions, exchange assets, or refrain from doing things. Alegally valid contract is reached through mutual agreement by persons with the capacity to negotiate, in which each gives up something of value. It must be for a lawful purpose.
  2. Futures. (1) A trading unit in a financial future; (2) An agreement between buyer and seller of a futures contract as defined by a commodities exchange or exchange clearinghouse.
  3. Foreign Exchange. An agreement by two parties to exchange one currency for another at a specified future date.

agreement between two or more parties whereby each party promises to do, or not to do, something; a transaction involving two or more individuals, whereby each has reciprocal rights to demand performance of what is promised.

in insurance, agreement between an insurer and an insured under which the insurer has a legally enforceable obligation to make all benefit payments for which it has received premiums.

In general: legal agreement between two or more parties, such as that between an advertising agency and its clients, that describes the services to be performed and the price and payment terms.

an agreement between competent parties to do or not to do certain things for a consideration .

Example: To have a valid contract for the sale of real estate there must be:

  1. an offer
  2. an acceptance
  3. competent parties
  4. consideration
  5. legal purpose
  6. written documentation
  7. description of the property
  8. signatures by principals or their attorney-in-fact
