4:14 PM Enron's Skilling Sentenced to More Than Two Decades

Strength among the blue-chip names helped drive the Dow Jones Industrial Average (DJIA - 12,115.5) to another record-setting high on Monday, kicking the week off in fine fashion. By the close, the index was just off its intraday peak, settling above the latest round-number hurdle at the 12,100 level. Just three of the 30 DJIA names slid lower on the day: American Express (AXP: sentiment, chart, options), Walt Disney (DIS: sentiment, chart, options), and United Technologies (UTX: sentiment, chart, options). The S&P 500 Index (SPX - 1,376.97) wasn't too shabby either, hitting its highest level since February 2001. Elsewhere, the Nasdaq Composite (COMP - 2,355.6) gained nearly 0.6 percent and is within 20 points of its annual high. While the blue chips and technology issues rallied, the Russell 2000 Index (RUT - 763.52) was left to settle for scraps, finishing a mere fraction above breakeven for the session.

In what may in fact be among the final chapters to the Enron scandal, the disgraced company's former CEO Jeffrey Skilling has been sentenced to 24 years, four months in prison. At his hearing, Skilling told U.S. District Judge Sim Lake, "Your honor, I am innocent of these charges ... I'm innocent of every one of these charges." In May, Skilling was found guilty of 19 counts of fraud, conspiracy, and insider trading.

In earnings news, Netflix (NASDAQ:NFLX) said it banked 18 cents per share in the third quarter, up from 11 cents the previous year and six cents better than the consensus estimate. Revenue surged 48 percent during the period to $255.9 million. In after-hours trading, the shares have rocketed more than 18 percent higher.

1:58 PM Gold Slips

December gold finished the session with a loss of $13.50, closing at $582.90 an ounce. Meanwhile, December silver retreated 29.5 cents to end at $11.67 an ounce Monday. Both closing levels marked the weakest closing levels for the contracts since October 12. December copper fell by 1.1 cents to close at $3.451 a pound.

In earnings news, American Express (NYSE:AXP) announced that third-quarter earnings slipped six percent to $967 million, or 80 cents per share. Revenue climbed 12 percent to $6.8 billion. The Street had predicted a profit of 76 cents per share and revenue of $6.8 billion.

Dow Jones & Co. has climbed more than three percent after it was upgraded to "buy" from "hold" at Deutsche Bank Securities. The firm also lifted its price target on the stock to $39 from $35.

12:04 PM Dow, S&P, Hit New Heights

A USB/Gallup poll surveying investor optimism posted a gain for the second month in a row. The index rose five points in October after jumping 21 points last month. The reading now stands at a seven-month high of 79. In October, 53 percent of investors said they are optimistic about the equity market's performance, up from 47 percent the month before.

In stock news, Hasbro (NYSE:HAS) has zoomed more than five percent higher to a new annual peak. The stock announced third-quarter earnings of $99.6 million, or 58 cents per share, from $92.1 million (47 cents) the previous year. Revenue rose to $1.04 billion from $988.1 million. Analysts were expecting per-share results of 50 cents on $963 million in sales.

10:50 AM IBM Files Lawsuit Against Amazon.com

IBM (NYSE:IBM) announced that it has filed two patent infringement lawsuits against Amazon.com for unspecified damages. IBM stated that the patents cover interactive applications, interactive network data storage, advertising in interactive service, hypertext link adjustments and electronic catalog ordering.

Wal-Mart Stores (NYSE:WMT) reported that it will slightly slow down new-store growth in fiscal-year 2008 while significantly reducing capital expenditures. Speaking at an analyst conference, the firm will increase new-store growth throughout the world by about 7.5 percent next year compared with an average eight-percent increase of recent years. Overall, the company plans to open more than 600 new stores, representing about 60 million square feet in a variety of formats.
