Rights and obligations of both the franchisor and the franchisee are detailed in the franchisor’s disclosure documents, but as I’ve said many times before, it’s up to the franchisee to perform SERIOUS DUE DILIGENCE to dig out these and other important issues that often remain out of sight and out of mind until AFTER THE INVESTMENT IS MADE. Beyond the importance of understanding rights, obligations, termination, cures, and fees, there is another enormous reason for performing proper due diligence. Of course, that reason would be to determine if things may be inferred or promised during the sales process are compatible with the actual language found in the franchise agreement.
