I've read quite a bit about legal plans for small businesses, but always come back to the same nagging questions. First, if I were a small business owner, I would be concerned about the quality of the representation I was receiving. Sure, a free telephone call to a lawyer is great, but how does the business owner know he's getting the right lawyer or someone who is not-so-right and starving for business (hence the listing on a legal plan network)? Second, as a small business owner, I would want my lawyer to know me and my business and be a partner in preserving or growing my business. An assigned lawyer, anonymous to me, would seem to be counterproductive to that objective. After all, clients hire lawyers they know and trust. Seems to me that a small business owner who uses a pre-paid legal plan may be penny wise and pound foolish. But I could be wrong.

Hi I found your post to be very true and insightful. If you come off as being someone by your first impression, that is who you should be down the road. A first impression usually depicts a brief vision of who you are, Putting on an act, or faking yourself to impress someone will only harm your success and hold you back from discovering your true-self. Thanks for your comments, Joe. I agree that often you are engaged to be a hired gun. I would imagine, however, even in such situations, opportunities exist for creativity and proactivity that are often overlooked by attorneys. In chicken and egg style, lawyers embrace the image of being a hired gun in response to what they perceive the client wants or needs and the client determines that what the client needs is a hired gun based on the client's perception of what lawyers bring to the table. I also agree that the people who run businesses do not contact their attorneys early enough. For small businesses, this is often due to a perception (created I believe by the use of billable hour billing) that contacting an attorney costs money and is to be avoided except as a last resort. For larger businesses, unfortunately, the attorneys are often perceived as deal-killing naysayers. Neither situation is optimal. That is why the concept of strategic lawyering is appealing.

Good article. While it has high aspirations for us lawyers in the trenches, it ignores many realities of the practice of law, particularly litigation work, where the client often wants a "no holds barred" litigator to take the case from point A to point B. This is particularly true of many larger companies or companies that are often targets of litigation. There is usually team of well-educated and litigation savvy in-house folks who are hiring you to address a particular problem, a particular lawsuit, and would be quite offended to be getting business advice from their "hired gun." The paradigm suggested in the article would have more applicability to smaller (or mid-size) businesses that do not have the full complement of in-house expertise, but only those that have the resources to hire the strategic lawyer. Plus, in my experience, small business owners (even the succesful ones) usually wait until they have a problem before they go to a lawyer because they perceive using the lawyer at the inception of whatever deal they've created as not cost effective. Perhaps we need to do a better job of educating the client about the strategic services we can offer. But then, again, they need to use us. You can lead a horse to water, .....

Mr. Cathy (Chick-fil-A) is well-intentioned in closing on Sunday. However, Sunday is not the Sabbath of the Bible, it is a secular day. The day God sanctified is the seventh day, not the first day (see Genesis 2:2-3). This is reinforced in the Ten Commandments (#4) as found in Exodus 20. It is the only commandment that begins with the word "remember." Jesus reaffirmed the seventh-day Sabbath (see Luke 6:5 and Mark 2:27-28). There can be no argument regarding which day is the first and which day is the seventh--Jews throughout time have been keeping the same seventh day (the day we call by its pagan name, "Saturday"). Unfortunately, when Christianity was blended with paganism (during Roman Emperor Constantine's rule), the true Sabbath of the Bible was eventually substituted with the first day. There have been many, many ministers I know who for many years have offered substantial rewards to anyone who can prove from the Bible that the sanctity of the seventh day was transferred to the first day. No one has been able to do it. Sunday sanctity is a tradition of man. "...in vain do they worship me, teaching for doctrines the commandments of men. For laying aside the commandment of God, you hold the tradition of men...making the word of God of none effect through your tradition..."Mark 7:7-8, 13.

Hiring a business attorney is important. However, when dealing with trademark infringement and the Internet it is still the wild west. For example, I have a competitor that is violating my trademark. I talked with several different lawyers and they said there isn't much that can be done. Here is a brief overview of what my competitior is doing:

First, they are bidding on a variation of my trademark on the PPC search engines. They aren't bidding on the exact trademark, but a variation of the mark. They are using the variance of the search engine to bid in my exact term. Thus, when someone types the name of my product in a search engine, my competitors sites appears before mind. Technically they aren't violating my mark, according to the lawyers I talked to.

Second, they describe every detail of my product on their website. The statements they make on their site says my product doesn't work. Combining this with the bidding on my trademark, it may be costing me some business. I haven't noticed any decline in sales but it is a slimy business method practiced by slimy business owners.

However, the lawyers I talked with said it is legal since my competitor isn't actually bidding on my trademark. Thus, no violation exists.

If you can find a good lawyer, use them, but sometimes a IP lawyer can't help with trademarks.

Almost, but not quite. Quadrant 1 and 3 get done the most, because of the time pressure. Quadrant 1 are the "do it or you're fired" types of tasks. Given a Quadrant 1 and anything else, people will do the Quadrant 1 first.

Deadlines do motivate - even implied ones. An unanswered phone eventually goes to voicemail or gets dropped - and consequences may ensue.

The hierarchy of how people will do tasks is Quadrant 1, Quadrant 3, Quadrant 4, and finally Quadrant 2. One can reasonably argue that the "proper" order is 1, 2, 3, 4. The dilemma comes from the fact that all tasks other than Q2 are usually short-term focused, while Q2 tasks are usually strategic, longer-term focused, which would explain why they get deferred in our culture. In Asian cultures which value longer time horizons, Q2 activities are given higher priority.

OK, I'll be a heretic. I totally disagree with this. What you should lead with is something that gets attention - whether it's visual, aural, humorous, controversial. Get the audience to sit up and wonder "what the heck is he doing?"

Then make the "why should you care?" or the "what problem do I solve?" (although without the "I") statement, linked to then opening.

They then understand why you're here... and why they're here.

No, it's not a typical corporate presentation - and that's the point. As a speaker, you want first and foremost to be memorable. Damn the standards, as long as they remember your premise - and hopefully, that they buy into it, too.
