Hi Mitchell,

Thank you for the mention. A pure start-up is obviously different than a franchise start-up.

If a young entrepreneur has an idea for a company, and can get it funded, I say go for it.

If franchisors are starting to target younger franchise prospects for the wrong reasons, then it's a problem.

I have talked to maybe 2-3 young franchise prospects in my 8 years in franchise consulting. Both meetings were really short. They just didn't get it yet, because they couldn't. Not enough experience.

A start-up entrepreneur experiences things during their experience. That's totally different, Mitchell.

I'm sticking to my story.

Terry writes: "If you?re looking at franchises you?re actually validating a system. That system is already tested and proven. There are likely several people out there operating that system getting the results that you?d want for yourself. Even if the franchise company is relatively new what you need to determine is your ability and your willingness to follow that system to make your business successful."

There is no legal requirement that a franchisor have a proven system before they sell their concept.

No less a franchise authority than Michael Seid testifying as a expert witness "states in his documents that he knows of "no legal or industry requirement that a franchise opportunity must be tested in any particular manner, or that a franchisor cannot sell a franchise opportunity until it has been proven by prior franchisees." He writes that the Federal Trade Commission and state regulators have not established a franchisor "Duty of Competence." Instead, he states, they require franchisors to disclose accurately their experience and history, whatever that may be.
